Graphis — Terms of Service

Welcome to Graphis.
These Terms of Service (“Terms”, “Agreement”) govern your access to and use of Graphis’ website, products, and related services (collectively, the “Platform”).
By using Graphis, you agree to these Terms. If you do not agree, please do not use the Platform.
1. Overview
Graphis provides tools for creative collaboration, automation, and AI-assisted content generation.
These Terms form a legal agreement between you (“User”, “you”) and Surnin Synergy Ltd, a company registered in the United Kingdom.
2. Account and Access
- You must be at least 16 years old to use Graphis.
- You are responsible for maintaining the security of your account and password.
- You must provide accurate and up-to-date information during registration.
- Graphis reserves the right to suspend or terminate your account if you violate these Terms.
3. User Content and Ownership
- You retain full ownership of all content you create, upload, or generate on the Platform (“User Content”).
- By using Graphis, you grant us a limited, non-exclusive, revocable license to store, process, and display your User Content solely for the purpose of providing our services to you.
- Graphis does not claim ownership of your content and does not use it for training AI models or for marketing without your explicit consent.
- You are solely responsible for ensuring that your content complies with applicable laws and does not infringe on any third-party rights.
4. Content Deletion
- You may delete your entire project or account at any time.
- When you delete content inside a project, it will be permanently removed from our active servers within 1–7 days.
- Backups may temporarily persist in encrypted form before being automatically purged.
5. AI and Third-Party Services
- Some features rely on third-party AI models and APIs.
- Graphis does not control or guarantee the output quality, accuracy, or originality of generated content.
- You are solely responsible for reviewing and using AI-generated results in compliance with applicable laws and intellectual property rights.
6. Acceptable Use Policy
Your access to and use of the Graphis Platform is conditional upon your compliance with this Acceptable Use Policy. You are solely responsible for your conduct and any content you create, submit, post, or share using our services.
6.1. Prohibited Activities
You agree not to engage in, or attempt to engage in, any of the following activities:
- Unlawful Use: Using Graphis for any unlawful, fraudulent, or harmful purpose, or in furtherance of any illegal activity.
- Platform Security Violations: Interfering with, disrupting, or attempting to gain unauthorized access to our services, servers, or networks. This includes hacking, bypassing security measures, or placing an unreasonable load on our infrastructure.
- Data Mining: Using any automated means (spiders, scrapers, bots) to access or collect data from the Platform without our prior written consent.
- Harming Other Users: Harassing, abusing, stalking, threatening, or otherwise violating the legal rights of others.
- Deception and Impersonation: Impersonating any person or entity, or misrepresenting AI-generated content as solely human-created in a deceptive or harmful manner.
- Intellectual Property Infringement: Using Graphis to create, share, or promote content that infringes upon any copyright, trademark, patent, trade secret, or other intellectual property right of any party.
6.2. Prohibited Content
You agree not to create, upload, post, or distribute any content that:
- Is Hateful or Discriminatory: Contains hate speech, or promotes discrimination, disparagement, or violence against individuals or groups based on race, ethnic or national origin, religion, sex, gender identity, sexual orientation, age, disability, or any other protected characteristic.
- Is Violent or Graphic: Depicts extreme violence, gore, torture, or cruelty to humans or animals.
- Is Sexually Explicit: Includes pornography, child sexual abuse material (CSAM), or any other content that is sexually explicit or exploitative.
- Promotes Self-Harm: Encourages, promotes, or provides instructions for self-harm, suicide, or other dangerous acts.
- Violates Privacy: Shares the private, personal, or confidential information of others without their express consent (doxing).
- Is Misinformation or Disinformation: Spreads knowingly false or misleading information that could cause harm to public health, safety, democratic processes, or well-being.
- Is Terrorist Content: Is created by or in support of terrorist organizations, or that promotes, encourages, or glorifies acts of terrorism.
6.3. Enforcement
We reserve the right, but do not have the obligation, to determine in our sole discretion whether any conduct or content violates this Acceptable Use Policy. In the event of a violation, we may take any action we deem appropriate, without prior notice, including:
- Removing or disabling access to the prohibited content.
- Suspending or permanently terminating your access to the Platform.
- Reporting your activities and providing your information to law enforcement authorities if we believe it is necessary.
This list of prohibitions is not exhaustive. We reserve the right to update this policy at any time. Your continued use of the Platform after any changes constitutes your acceptance of the new terms.
7. Payment and Subscriptions
- Some features of Graphis are available through paid plans or subscriptions.
- Payments are handled by third-party payment providers (e.g., Stripe).
- Subscriptions automatically renew unless cancelled before the renewal date.
- Fees are non-refundable except where required by law.
8. Service Availability
- Graphis strives to provide continuous access but cannot guarantee uninterrupted service.
- Features may change, be suspended, or discontinued without prior notice.
9. Limitation of Liability
- Graphis is provided “as is” and “as available”, without warranties of any kind.
- Graphis Ltd shall not be liable for any indirect, incidental, or consequential damages, including data loss or business interruption.
- Our total liability shall not exceed the amount you paid to Graphis in the past 30 days.
10. Termination
- You may delete your account at any time.
- Graphis may suspend or terminate access if you breach these Terms or abuse the service.
- Upon termination, your access will cease and your content will be deleted in accordance with Section 4.
11. Changes to the Terms
We may update these Terms from time to time. Significant changes will be announced via email or on the Platform. Continued use of Graphis after updates constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
